Domain registration agreement

Version 2026-09-25, in effect from September 25, 2026.

This domain registration agreement ("Agreement") applies whenever you register, transfer, renew or manage a domain name through Server Room ("Server Room", "we", "us", "our"), on its own or together with another service such as web hosting. "You" and "your" mean the person or organization that places the order.

It adds to our Terms of Service, Refund Policy and Privacy Policy, which also apply. Where they differ on a domain name, this Agreement governs.

When you tick the box at checkout, you confirm that you have read this Agreement and accept it for the domain names in that order. It then applies to every renewal of those names and to every change you make to them.

1. Who you contract with

• Data Room, Inc., State of New York, United States, operating as Server Room: every domain name we invoice in US dollars, which is every extension except .ro.
• DATA ROOM SRL, Bd. Dimitrie Pompeiu 8, Sector 2, 020337 Bucharest, Romania (Trade Register J2008002031178, CUI 24664650): .ro domain names, which we invoice in euros.

The invoice for your order names the company you contract with.

2. What we do, and the registrars we use

We are not a domain registrar ourselves. We order, renew and manage domain names for you through accredited registrars and registries:

• Porkbun, LLC, an ICANN-accredited registrar, for every extension except .ro. Porkbun's Domain Name Registration Agreement and its registry conditions for each extension apply to these names, and by ordering one you agree to them as well.
• ROTLD, the .ro registry, for .ro names, under its registration rules.
• Namecheap, Inc., an ICANN-accredited registrar, for domain names you moved to us from a partner brand's account. Those names stay registered at Namecheap under its Registration Agreement; we manage and renew them for you.

Each registry sets rules for its own extensions, and those rules apply to your domain name. For generic extensions such as .com, ICANN's Registrant Benefits and Responsibilities and Registrant Educational Information describe your rights and duties.

3. Who holds the domain name

• A .ro name is registered in the name of the holder you give us: you, or the organization you order it for. The registry files the name under that identity, so it must be correct and it must be yours to give.
• For other extensions, the registrar records the registrant contact we give it. Until you set your own, that is our company's contact, with WHOIS privacy switched on, and we hold the name on your behalf and act on it only on your instructions. You can put your own details on the name at any time from the Domains page of your dashboard; the registrar may ask you to confirm the change by email. From then on you are its registrant of record.
• Either way the domain name is yours to use, point, renew, move to another provider or let lapse, as this Agreement describes.

4. Your information

You must give us, and keep up to date, complete and accurate information about yourself and the name's contacts: name, organization, postal address, email address and phone number.

Registrars and registries are required to verify this information. They may suspend or cancel a domain name when it is false, out of date, or not confirmed when they ask; under ICANN rules, a registrar may suspend a name whose registrant does not respond to a verification request within 15 days.

We pass your information to the registrar and the registry, which publish or disclose it as their rules and data protection law allow. Where the registrar offers WHOIS privacy, we switch it on. Our Privacy Policy sets out how we handle personal data.

5. Availability and ordering

A name shown as available is not reserved until the registry accepts its registration. If someone else registers it first, or the registrar or the registry refuses it, we refund what you paid for it or, if you prefer, credit it to your account.

Some names cannot be ordered online: premium names priced by their registry, extensions with eligibility requirements, and names the registrar holds back for review. We tell you so before you pay.

6. Fees and payment

You pay the price shown when you order, for one year of registration. A transfer also adds one year to the name's current term. We start a registration or a transfer only after your payment has been received.

Renewals are charged at our price in force when the renewal is invoiced. It follows the registry's and the registrar's prices and may differ from the first year's; the renewal invoice shows it before you pay. Taxes are added where the law requires them.

7. Renewal and expiry

We invoice each renewal 30 days before the name expires and renew the name once that invoice is paid.

If a renewal is not paid by the expiry date, the name expires. The registry's grace and redemption periods may then apply: restoring a name in its redemption period costs an additional fee set by the registry, and once those periods end the name is deleted and anyone may register it. We send reminders to the email address on your account, but keeping your names renewed is your responsibility.

8. Transfers

• To us. A transfer needs the authorization code from your current registrar, and the name must be unlocked and free of any transfer restriction. The registry decides whether a transfer goes through; one that is refused or fails is refunded or credited as in section 5.
• Away from us. You can move a name to another provider at any time, except where registry or ICANN rules prevent it, for example within 60 days of its registration or of a previous transfer, or while a dispute over it is pending. We give you its authorization code on request, from the Domains page of your dashboard or on a support ticket where the registrar requires it, and remove any lock we control. Fees already paid are not refunded when a name moves away.

Registry and registrar rules may also restrict transfers for a period after a change of registrant.

9. Acceptable use

You may not use a domain name, or let it be used, for anything unlawful or abusive, including phishing, malware, botnets, spam, fraud, infringement of another party's trademarks or copyright, or content the law prohibits. You confirm that, to the best of your knowledge, neither the name nor the way you intend to use it infringes anyone's rights.

We, the registrar and the registry may suspend, lock, transfer or cancel a domain name to comply with the law, an order of a court or authority, a dispute decision or the registry's or ICANN's rules, or to stop abuse. We cooperate with lawful requests from the authorities. A .ro name on the gambling blacklist of Romania's National Gambling Office (ONJN) cannot be transferred to us.

10. Disputes over a domain name

If a third party claims rights in your domain name, the dispute is decided under its registry's policy: for generic extensions such as .com, ICANN's Uniform Domain Name Dispute Resolution Policy (UDRP) and, for newer generic extensions, the Uniform Rapid Suspension System (URS); for .ro, ROTLD's rules and the Romanian courts.

You agree to take part in such proceedings, and we and the registrar will carry out their decisions. Registering a name does not protect it from such a claim.

11. Refunds and your right of withdrawal

A registration, renewal or transfer fee pays for work the registry does the moment it accepts the order, and that work cannot be undone. Once the registry has accepted a registration, renewal or transfer, its fee is not refundable, including if the name is later cancelled, suspended or moved away before its term ends.

If you are a consumer, the law may give you 14 days to withdraw from a contract made at a distance. When you tick the box at checkout, you ask us to start the registration or transfer as soon as you pay, before those 14 days are over, and you acknowledge that you lose the right of withdrawal once the registry has accepted it (Article 16(a) of Directive 2011/83/EU; Article 16(a) of Romanian Government Emergency Ordinance no. 34/2014). Until then you can cancel the order and be refunded in full.

12. Our responsibility

We order, renew and manage your domain names with reasonable care. We do not control registries or registrars and are not responsible for their acts, errors or delays, for whether a name is available, for its value, or for a name that lapses because its renewal was not paid in time.

Our liability for a domain name is limited as set out in our Terms of Service and never exceeds the fees you paid us for that name in the twelve months before the claim, except where the law does not allow that limit. You will indemnify us, the registrar and the registry against third-party claims arising from your domain name or its use, as the Terms of Service describe.

13. Changes to this Agreement

Registries, registrars and ICANN change their rules, and we may update this Agreement to follow them or to reflect changes to our service. Every update is published on this page with a new version date, and we email you about any change that affects your rights. A change applies to your names from their next renewal, unless the law or a registry requires it sooner; if you do not accept it, you can move your names away before then (section 8).

14. Ending this Agreement

This Agreement lasts while we register or manage at least one domain name for you. For a given name it ends when the name moves to another provider, expires and is deleted, or is cancelled. Sections 9 to 12 continue to apply afterwards to anything that happened before.

15. Governing law

This Agreement is governed by the law, and subject to the courts, that the Terms of Service of the company you contract with name: the law of the State of New York for Data Room, Inc., and Romanian law for DATA ROOM SRL. The mandatory consumer protections of the country you live in still apply. Consumers in Romania may also turn to the alternative dispute resolution service of ANPC, the National Authority for Consumer Protection.

16. Languages and contact

This Agreement is published in English and in Romanian. For .ro names sold to consumers in Romania, the Romanian version prevails. Questions about it: support@serverroom.net. Billing: billing@serverroom.net.
